1.1 The “Get Going with Dulcolax” Contest (the “Contest”) begins on November 7th, 2018 at 0:00:01(EDT) (the “Contest Start Date”) and ends on November 4th, 2019 at 23:59:59 (EDT) (the “Contest End Date”). The period between the Contest Start Date and the Contest End Date is the Contest period (the “Contest Period”).
2.1 To be eligible to participate in the Contest, a participant must be a natural person who is a legal resident of a Canadian province or territory and has reached the age of majority in his or her province or territory of residence at the time of participation in the Contest.
2.2 Employees of Sanofi Consumer Health Inc. (the “Sponsor”) and of their respective affiliates, promotion agencies, representatives and agents involved in the development, production and distribution of material related to this Contest (collectively, the “Contest Entities”), and any person which whom such persons reside are not eligible to participate in the Contest.
3.1 No purchase necessary. To participate in the Contest, a participant (the “Participant”) must sign up to the Get Going with Dulcolax program on the Dulcolax website (www.dulcolax.ca) during the Contest Period, Limit of one (1) entry form per person, during the Contest Period. The Participant will obtain one (1) entry into the draw (as described in Section 4 ) (an “Entry”) upon submitting a valid entry form in compliance with these Rules.
3.2 In the event of a dispute regarding an Entry, the Participant will be deemed to be the authorized account holder of the e-mail address associated with the Entry at the time the Entry was validated. For the purpose of these Rules, “authorized account holder” of an e-mail address shall mean the individual who has been assigned the e-mail address by the relevant Internet access provider, on-line services provider or other organization responsible for assigning e-mail addresses for the domain name associated with the e-mail address. The Participant may be required by the Sponsor to provide proof that he or she is the authorized account holder of the e-mail address indicated on the chosen Entry.
3.3 All information provided by the Participant for the purposes of the Contest must be truthful, accurate and complete. The Sponsor reserves the right to disqualify any Participant whose Entry contains false, incorrect or incomplete information.
3.4 The Sponsor may request proof of identity or of eligibility from the Participant at any time. Failure to provide such proof within a reasonable time may lead to the disqualification of the Participant.
4.1 Every three (3) months, one (1) Entry among Participants across Canada will be chosen (the ‘’Winner’’), during a random draw (from a campaign management platform using a random algorithm) among all eligible Entries received in accordance with these Rules. The draw will take place on February 5th, May 7th, August 6th and November 5th, 2019 at approximately 2:00 pm (EDT) at the offices of Deloitte located at Bay Adelaide Centre, Adelaide Street West, Suite 200, Toronto, Ontario M5H0A9. Odds of winning a Prize (as defined below) depend on the number of eligible Entries received.
4.2 The Winner will be contacted via e-mail (by which they signed up into the Get Going with Dulcolax program) by the Sponsor’s representative (OgilvyCommonHealth) following the date of the draw. In the event the Sponsor is unable to notify the Winner within a reasonable period or if the Winner does not respond to the e-mail sent by the Sponsor’s representative within a period of two (2) business days following the first contact, the Winner will be disqualified and a second Winner will be chosen from all remaining eligible Entries. In the event the Sponsor is unable to notify the second Winner within a reasonable period or if the second Winner does not respond to the e-mail sent by the Sponsor’s representative within a period of two (2) business days following the first contact, such second Winner will be disqualified and the Sponsor will have the right, at its sole discretion, to cancel the award of the Prize or to select another Winner among all remaining eligible Entries.
4.3 The Prize: The Winners (1 winner every 3 months) will receive an Apple Watch Series 4 (GPS).The total value of $519 CAN per Winner. Total contest value (12 months) is $2 076 CAN.
5.1 By entering the Contest, each Participant:
(a) agrees to be bound by these Rules;
(b) agrees not to hold liable the Contest Entities and their respective directors, officers and employees, for any prejudice, loss or damages of any kind incurred by the Participant or to any other person, sustained wholly or in part, directly or indirectly, from the acceptance, possession, use or abuse of the Prize, the participation in this Contest, or any activity related to the Prize.
(c) agrees to indemnify the Contest Entities and their respective directors, officers and employees, for any claims related to any violation of these Rules by the Participant.
5.2 The Participant further accepts to comply with the Sponsor’s decisions, which are final. The Sponsor reserves the right, at its sole discretion, to disqualify a Participant who violates these Rules, disrupt or attempts to disrupt or alter the participation process or the operation of the Contest.
6.1 The Sponsor will not be held liable for any entries, communications, responses and that are lost, delayed, destroyed or misdirected or for any other technical defect, including those related to computers, software, telecommunications networks, telephones or Internet connections. The Sponsor assumes no liability for false or incorrect information, caused either by the users or by any equipment or program associated or used in connection with the Contest or for any human or technical error that may take place during the Contest process.
7.1 By entering the Contest, the Participant agrees to the collection, use and disclosure by the Sponsor or its authorized agents of the Participant’s personal information provided through the Entries for the purpose of carrying out the Contest and delivering the Prize.
7.2 Personal information may be transferred to third parties that are retained by the Sponsor to perform storage, management and other similar functions, subject to the laws applicable to the protection of personal information and the Sponsor’s internal policies regarding personal information. Files containing personal information will be kept at the Sponsor’s or its service provider’s offices or on their servers and employees who require access to personal information in order to fulfil their job requirements will have access to these files. To the extent provided by applicable law, the individuals concerned may request access to the file containing their personal information and the correction of such information by contacting the Sponsor at firstname.lastname@example.org.
7.3 The Sponsor may, with the written consent of the Winners, without any additional notice or compensation, copy, reproduce, publish, broadcast, communicate by telecommunication, exhibit, disseminate, adapt, use and reuse his or her name, declarations, image, photos, testimonials or other representations or recordings for publicity purposes relating to the products using any media and in any format.
8.1 All intellectual property rights in the Contest promotional material, including in the content of any web pages related to the Contest, are held and remain with the Sponsor or its licensors. All rights are reserved. Unauthorized reproduction or use of any material without the express written consent of its owner or holder is strictly prohibited.
9.1 These Rules are the official rules of the Contest. The Contest is subject to all applicable laws and regulations. Subject to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) when required, these Rules may be modified without prior notice, including to render these Rules compliant with all applicable laws.
9.2 Any dispute respecting the organization or conduct of the Contest may be submitted to the Régie for a ruling. Any dispute respecting the award of the Prize may be submitted to the Régie only for the purposes of helping the parties reach a settlement.
The Prize must be accepted “as is” and may not be transferred or converted to cash. The Prize may not be substituted, except at the Sponsor’s sole discretion. All Entries are the exclusive property of the Sponsor and will not be returned. Any attempt to deliberately damage any property or website related to the Contest or to hinder the legitimacy of the Contest process may constitute a violation of civil and criminal laws and the Sponsor reserves the right to initiate legal proceedings and claim damages to the extent permitted by law. The Entries are subject to verification and may be declared invalid if they are illegible, incomplete, mechanically reproduced, damaged, tampered with, falsified or altered in any way. No correspondence will take place in relation to the Contest, except for correspondence with the Winners. The Sponsor reserves the right, subject to the consent of the Régie, to annul, suspend or modify the Contest if a computer problem, an unauthorized human intervention or another cause beyond the control of the Sponsor alters or affects the security, fairness, integrity, management or adequate conduct of the Contest.
